Civil Litigation is the term for virtually any contested matter before a court or tribunal that is not a criminal matter. Civil matters can be tried before a Judge (bench trial) or before a Jury.
At the Law Offices of Timothy Dugan, we have successfully litigated civil cases at all levels of Courts, up to an including the North Carolina Supreme Court.
Civil matters are litigated or "tried" in one of three lower level "trial" courts. Civil matters may also be appealed to higher level "trial courts" or to the Appeallate Courts.
Small claims court is the least "formal," and involves cases with under $10,000.00 in dispute
District Court includes family law, contract disputes, and general civil matters with less than $25,000 in dispute
Superior Court includes matters with over $25,000 and Special Proceedings, such as Will Challenges
The North Carolina Court of Appeals and the North Carolina Supreme Court hear cases appealed from the lower level trial courts
